Met facebook is haast geen contact te krijgen.
Iemand een idee hoe ik mijn page weer terug krijg? -

"What your attorney fails to see is that you're using it on Facebook - which is an American company/social platform etc; so even if you're in Holland you are breaching my common law US trademark rights through Facebook and Twitter... and mind you, your attorney pointed out that I have a trademark infringement claim against in the the U.S. under the common law... so you appear to be the ass, not me.
Also, I've received emails from a xxx domain, which I've flagged as spam. If you or anyone else you're associated with is trying to send me information -- it must come from a actual domain and valid email address, otherwise it's disregard and marked appropriately as spam and thus, not received.
I'll leave the rest of this up to my lawyer and her expertise. This situation is not worth my time, as you pointed out, you are a no body... it's just a shame and a testament to your character how unoriginal you are. Here in America, we call people like you douches. I hope that translates in Dutch.
The kind of person you are really shows. Hope that is not representative of the Dutch.

My European trademark attorney wrote me this:
"Under European trademark law, an absolute requirement is registration. There is no registered or published pending trademark application for HAPPY HERBIVORE or any variation I can think of. There is no way for her to sue for trademark infringement at this time. If she claims to have a nonpublished pending application, we'll have to wait until it is published so we can file an opposition (protest) based on your prior use in the European Union. It's illegal by the way to falsely claim you have a pending application.
We do not have anything similar to the common law trademark right of the US. If it's not registered, you have no rights, no matter how long you used it.
She talks about "suing for copyright infringement" but that is something else entirely; we are talking about trademarks, not copyright. There's no way she can sue for copyright infringement over just the word HAPPY HERBI.
You are not active in the US so I don't see how you would infringe a US trademark. If she falsely represents to Twitter or Facebook that you are doing so, you'd have grounds to sue her for damages. The TOS for these services require that you *infringe* a trademark, not merely that you have a username that is similar to someone's trademark somewhere in the world."
Hopelijk ben ik nu van haar af.

Jul 30, 2010 om 10:51Buitenlandse partij eist naamsverandering wegens te grote overeekomsten?Ik heb net gebeld naar handelsnaaminbreuk, en daar zeggen ze ook dat ik me niet druk hoef te maken omdat Lindsay als ze me echt iets wilt maken naar een Nederlandse rechter moet stappen.
Ze zegt inderdaad ook dat we ons allebei op een ander gebied focussen. Ik op Nederland en zij op Amerika.
En dat ik me idd pas zorgen hoef te gaan maken als ik post krijg uit Amerika.
Op gratis adviseurs.nl kreeg ik de volgende reactie
Als eerste is relevant of deze dame eerder dan jij de domeinnaam Happy Herbivore voerde. Als dat niet zo is en jij dus eerder was met de registratie van de domeinnaam HappyHerbi, dan kan zij - in beginsel - weinig doen tegen het gebruik van de domeinnaam.
Indien zij een merkenrecht heeft op haar naam Happy Herbivore dat geldig is in Nederland, kan zij met een beroep op het merkenrecht actie ondernemen tegen gebruik van domeinnamen die op het merk lijken. Voor zover ik nu even snel kan zien in het merkenregister van het Benelux merkenbureau (BBIE) heeft zij in Nederland geen geldig merkenrecht. Ik denk dus dat zij weinig tegen jou kan ondernemen op basis van het merkenrecht.
Ook op basis van het handelsnaamrecht kan zij in mijn ogen weinig ondernemen. Ik acht het namelijk niet aannemelijk dat zij in Nederland enige bekendheid geniet nu zij een Engelstalige website exploiteerd en zich voornamelijk richt op de Amerikaanse markt. Het is zelfs zo dat indien zij zich op enig moment expliciet richt op de Nederlandse markt, jij wellicht iets tegen haar kan ondernemen. Waar het in het handelsnaamrecht om gaat is het verwarringsgevaar. Kort gezegd gaat het er om dat een gebruiker van een handelsnaam zich kan verzetten tegen een ander die een gelijkluidende handelsnaam gebruikt. In dit geval ben jij actief in Nederland en kun je je verzetten tegen een ieder die in Nederland de handelsnaam Herbi Herbi gebruikt.
Al met al denk ik dat je geen risico loopt. En het is zeker niet zo dat je dan wordt veroordeeld om miljoenen te betalen. Het enige risico is dat je de domeinnaam moet staken mocht het ooit komen tot een procedure.
Nu was zij wel eerder met de naam Happyherbivore.com en ze beweert dus wel fans in Nederland te hebben. -

Geachte mevrouw,
Indien u de naam blijft gebruiken en de andere partij gaat een gerechtelijke procedure beginnen, zal de rechter bepalen of beide namen zodanig op elkaar lijken, dat er verwarring kan ontstaan.
Of u wel of niet zult winnen is daarom niet te voorspellen.

I didn't refuse to change my name, just give me some time to figure this out. I already changed my twittername and contacted the host of my website. I don't no how to change the name of my facebookpage. But facebook will probably contact me..

Have you spoken to an actual trademark lawyer? I wouldn't trust the opinion of people who don't understand the complexity of the laws.
If you insist on refusing to change it, I'll be happy to file claims with twitter and facebook and start a legal action against you personally as well for copyright infringement.
I'll have my lawyer start on the paperwork now.
It's really unfortunate that you're forcing it to come to this... and a testament to your character that you're trying to mooche off of my hard work and celebrity.
